"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances."
How do you get "separation of church and state" out of this? How does this convert to "no prayers in school?"
To me, what this says is Government is not to make laws restricting Church not shall they restrict the people from practicing religion.
Although the Supreme Court ruled against school prayer, that restricts schools and teachers from conducting prayers in our schools and school sponsored functions. Few people, including school boards, administrators and teachers realize that students are permitted to pray at school and school functions and can actually lead prayers. If school officials forbid student lead prayer it is a violation of the First Amendment and the Supreme Court ruling.
Judges who have the opinion that the Constitution is what they interpret it to be are wrong and have no place on the bench, whether Supreme or District. There job is to interpret the law, but not to make law. When you look at the history of this country and our founding fathers it is obvious that their intent was not to keep prayer out of schools.
Out next President and Congress should be looking to appoint and consent to judges who are willing to revisit this issue in a realistic world.
This is one more reason I keep saying...
Don't re-elect incumbents!
